A team of qualified opticians is on hand to answer any questions you may have by calling 03.21.91.40.40 to answer all your questions and help you place your order, Monday to Friday from 10:00 to 18:00, by e-mail at contact@mymonture.com and in our boutiques in St Martin Boulogne and Lille. sAS ANSEPIAL reserves the right to adapt or modify these terms and conditions of sale at any time. Prior to any transaction, the customer acknowledges that he/she has read these terms and conditions and expressly declares that he/she accepts them by clicking on the "I accept" button.
the Customer declares that he/she is a natural person of legal age (18 years and over), non-trading or professional, and that he/she has the legal capacity to commit him/herself without restriction under these GTC. The purchaser of corrective glasses or contact lenses certifies that he/she has parental consent for his/her purchase. Proof of parental consent must be provided at the request of SAS ANSEPIAL. For orders of corrective lenses or optical equipment subject to French legislation, THE CUSTOMER certifies that he/she has a prescription :
- less than 5 years old for those aged 16 to 42
- less than 3 years old for those over 42.
- one year old for those under 16.
This medical prescription from an ophthalmologist or general practitioner must be sent to SAS ANSEPIAL to complete the order. For orders placed by customers who are not subject to French legislation, the latter undertake to comply with the legislation applicable to them on the day the order is placed. SAS ANSEPIAL declines all responsibility where applicable.
2.products :
2.1 Conditions of use of the Products :
The Products are subject to precautions of use. The use of certain Products may be inadvisable or restricted for certain categories of Customers and/or uses.
The Customer undertakes to comply in all circumstances with the rules, indications and instructions given to him/her when purchasing the Products, whether by SAS ANSEPIAL, the manufacturer, an optician, an ophthalmologist or any other person authorized to do so. These rules, indications and instructions may concern the use or wearing of the Products, their storage, cleaning or treatment, etc.
SAS ANSEPIAL offers the full range of optical services normally provided by opticians with a physical store, such as the fitting and adjustment of corrective lenses (pupillary height) or the (adjustment of frames). Before using the Products, the Customer is therefore invited to take all the usual precautions, and in particular to consult an ophthalmologist and/or optician whenever necessary, to ensure that he/she has all the necessary information.to ensure the quality of their eyesight and their optical needs, and to fit and/or adjust their corrective lenses and frames, if necessary.
The products offered by SAS ANSEPIAL comply with current French legislation and with standards applicable in France and the European Union. However, SAS ANSEPIAL cannot guarantee the total compliance of the products offered with standards applicable in countries other than those of the European Union. For this reason, the customer is responsible for verifying that the products to be imported comply with the legislation applicable in the country of destination. Should the products be seized by the customs authorities, SAS ANSEPIAL. will not be held responsible and the seizure of the products will not give rise to any reimbursement.
2.2 Product availability:
Our product offers, gifts related to a promotional or commercial offer and prices are valid as long as they are visible on the site, within the limits of available stocks.
sAS ANSEPIAL makes every effort to ensure the availability of the Products offered for sale on the Site. However, the Customer is advised that Products may not be available or may no longer be available.
If the Product selected proves to be unavailable when the order is validated, the Customer will have the option of either validating the order and receiving the Product as soon as it becomes available again, or cancelling or modifying the order and being informed of the next availability date of the Product.
In all cases, the Customer will be notified by e-mail as soon as possible of any unavailability after validation of the order. If the Customer's account has already been debited, the Customer will be reimbursed within 14 days of receipt of the unavailability notification.
In the event of a replacement, the customer will be liable for the cost of reshipment at the current rate.
Products and/or gifts linked to a promotional or commercial offer are valid while stocks last.
in addition, SAS ANSEPIAL reserves the right to refuse or cancel any orders placed on the Mymonture.com website, without the CLIENT being entitled to claim any compensation in the event of, among other things: stock error, definitive unavailability of the product, obvious error in one or more products on the site, obvious price error, error or discrepancy between the prescription and the order, unfeasibility of the optical equipment, a dispute relating to the payment of a previous order.
For an order of more than three pairs of glasses and depending on the destination, Mymonture.com reserves the right not to honor the order in order to respect the commitments made to our suppliers, and to avoid customs problems for the customer with blocked packages.
2.3 Unavailability of products
In the event of unavailability of one or more products ordered from its suppliers, SAS ANSEPIAL undertakes to inform the customer as follows:
1°) Definitive unavailability
In the event that a product, available at the time of the order, becomes definitively unavailable for any reason whatsoever, SAS ANSEPIAL will inform the customer. The customer may then choose ;
* a replacement product of equivalent quality and price,
* or a refund of the unavailable product.
Reimbursement will be made without delay and at the latest within thirty (30) days, in accordance with the provisions of article L.121-20-3 of the French Consumer Code.
2°) Temporary unavailability
In the event that a product, unavailable at the time of ordering, becomes temporarily unavailable, SAS ANSEPIAL will inform the customer of the new period of availability. The customer may :
* maintain the order by accepting to wait,
* or cancel the order for the product(s) concerned.
In the event of cancellation, SAS ANSEPIAL will reimburse the sums paid for the unavailable products, without delay and at the latest within thirty (30) days, in accordance with the provisions of article L.121-20-3 of the French Consumer Code.
3°) Orders including products not immediately available
When an order includes one or more products that are not immediately available, shipment may be made :
* either all at once
* or in several partial shipments.
In the event of split shipments, additional delivery charges may be invoiced.
3. Ordering :
3.1 Customer account :
the Customer must create an account and identify himself on the Site in order to order Products.
To this end, he/she must enter his/her login details (e-mail address and password) and order details (first and last name, e-mail address, delivery address, etc.). The information entered must be kept secret and remains the sole responsibility of the Customer.
As this data is personal and secret, any order placed from the Customer's account is deemed to have been placed by the Customer, who is obliged to do so.
The Customer undertakes to inform SAS ANSEPIAL immediately of any loss of data, using the tools provided on the Site.
3.2 Placing an order :
prior to validating the order, the Customer has the technical possibility of reviewing the various stages of the order process and consequently modifying its content by adding or removing Products from the basket, from the Site page summarizing the contents of the basket. In this way, the Customer can modify his or her order until the order has been validated by clicking on the "Validate order" button, prior to payment of the order.
The Customer must validate his order only after verifying it. Validation of the order implies full acceptance by the Customer of the GCS and of the order, in accordance with applicable regulations.
Once the order has been validated, the Customer is invited to pay for the Products ordered via a totally secure "PAIEMENT 100% SECURISE" payment area.
The data entered by the Customer at the time of order validation constitutes proof of the date, nature and content of the transaction. This information may be archived by SAS ANSEPIAL as proof.
Once the Customer has validated and paid for his/her order, he/she will receive an email confirming his/her order, including the details and price of his/her order, the billing and/or delivery address, the delivery times envisaged and a partial summary of the important conditions of sale. This summary can also be found in the customer's account.
All orders placed after 2.00 pm will be processed on the next working day.

Any cancellation of an order at the time of dispatch for the purpose of measuring or mounting progressive lenses will incur a 10-euro handling charge.
3.3 Orders for corrective glasses and contact lenses:
Corrective eyewear :
* For all purchases of corrective eyewear, the customer must comply with the provisions of this article. SAS ANSEPIAL delivers corrective eyewear only under the following conditions:
* The customer must ensure that the references of the corrective eyewear provided in the order comply with the information relating to the adjustment made by an ophthalmologist or general practitioner. The customer must have regular eye examinations by an ophthalmologist in order to avoid eye damage.
* The wearer of corrective eyewear undertakes to be examined by an ophthalmologist at least every two years. When changing corrective eyewear, the wearer is advised to have the adjustment of the glasses checked by his or her ophthalmologist. If you have any questions about the risks and side effects of wearing corrective eyewear and contact lenses, please consult your ophthalmologist or specialist, and read the instructions carefully.
* CSS / CMU: For all orders of eyeglasses for CSS / CMU, it is imperative to have a signed agreement in order to deliver the equipment. No equipment will be dispatched without this signed agreement.
For contact lenses, the purchaser undertakes :
* To consult a recognized and authorized health professional (ophthalmologist) who will determine the various parameters and test the wearer's ability to tolerate them.
* The purchaser certifies that he/she is of legal age and has a medical prescription dating back less than 3 (three) years which has been given to him/her by a recognized and authorized health professional. All purchases must correspond to this prescription.
* The purchaser acknowledges that he/she has been informed in advance of the conditions of use, care and handling of the contact lenses and care products.
* The purchaser acknowledges that he/she is aware of the hygiene rules and instructions for use of the products purchased on the Site.
* The purchaser certifies that he/she has no contraindication to wearing contact lenses or using lens care products.
* The purchaser undertakes to use the Site in compliance with the legislation in force for his or her own personal needs and declares that he or she will not order for a third party, usurp the identity of a third party or use a name that he or she is not authorized to use.
* The buyer acknowledges that he/she has been informed of the possibility of seeking advice from an ophthalmologist or optician in a traditional store.
Please note that in the event of an order cancellation or error, a deduction of €30 per box of 6 lenses will be made. The lenses concerned are Perfexion HR RX Toric Progressive lenses, HR PerfeXion RX Toric lenses, ophthalmic Universel Hydrogel lenses (progressive, spheric, Toric, Toric Progressive), universal silicone Hydrogel progressive lenses (spheric, Toric, toric Progressive), Quantum 1 and 2 lenses, ultra Multifocal lenses for astigmatism, biofinity Toric Multifocal lenses, Z6 and Z6 contact lenses.
Trial lenses will be charged €4.90 for shipping and handling. For production trial lenses (RX etc...) a quotation will be sent to you in addition to postage and handling.
3.4 Discount and gift vouchers.
the customer may be asked to use discount and gift vouchers when placing an order, enabling him to take advantage of either discounts on the price of his order or temporary special offers.
To benefit from the effects of the various vouchers, the Customer must enter the voucher number when validating the order in the box specifically provided for this purpose.
Vouchers may be subject to specific conditions of use. For example, they are limited in duration and can only be used during a certain period of validity. The conditions of use of these vouchers are indicated on the vouchers in question. In addition, the various vouchers offered cannot be used cumulatively for the same order.
3.5 Orders placed in Metropolitan France
The price of Products is expressed in Euros, all taxes included (VAT), excluding delivery charges. In the event of a change in the VAT rate, the price of the Products will be automatically modified without any prior notice other than the date on which the new rate becomes payable, and the Customer will be responsible for payment of the VAT in accordance with the regulations in force. Prices shown are already discounted. Prices indicated on product sheets do not include transport.
3.6 Orders placed outside mainland France
In accordance with current legislation, SAS ANSEPIAL is obliged to charge VAT on orders shipped to most European Union countries.
In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. For all products shipped outside the European Union, to French overseas departments and territories and other local authorities, the price will automatically be calculated exclusive of tax on the invoice. Customs duties or other local taxes, import duties or state taxes may be payable. SAS ANSEPIAL is not responsible for these charges. They are your responsibility, both in terms of declarations and payments to the competent authorities/organizations in your country. The payment of these duties will not give rise to any reimbursement, discount or reduction in the amount of the order.
Before placing an order, the CUSTOMER is advised to check the duties, fees and taxes potentially incurred and payable by an import operation, and acknowledges that the VAT he/she may have to pay may vary depending on the country of the delivery address he/she has entered. In any event, SAS ANSEPIAL cannot be held responsible for the failure of the CLIENT to pay any taxes or duties. Warning: Any inaccurate information provided by the CLIENT for the purpose of evading VAT may result in civil fines and criminal prosecution.
4. Prices and payment :
4.1 Changes
MYMONTURE.com reserves the right to modify the price of its Products at any time without prior notice, except for validated orders. The current price is the one displayed when the order is validated by the Customer. WEB PRICES are exclusive to the Mymonture.com website, and may vary in stores or franchises.
4.2 Sale at a loss
MYMONTURE.com reserves the right to cancel any order at a loss or with a value of 0€ due to a computer problem. Resale at a loss is forbidden by law.
4.3 Payment of the order
The sale will not be concluded until Mymonture.com has validated the payment of the order, which constitutes acceptance of the offer and proof of the completeness of the order and of the payability of the sums due in execution of said order.
All orders are paid for in cash. The Customer must ensure that the necessary funds are available on the bank account used for payment of the order.
The Customer's order will not be final and delivery will not be made until full and complete payment has been received (acceptance of payment by means of the payment method below).
The Customer may pay for his order using the following methods of payment:

The Customer's bank details are accessible only by PAYPLUG. Neither SAS ANSEPIAL nor any third party can have access to the banking data entered by the Customer, as this data never passes through a server or a public page.
In order to prevent any attempt at fraud in the payment of an order, SAS ANSEPIAL and/or PAYPLUG reserve the right to ask the Customer for proof of identity and/or direct debit and/or bank details. In such a case, the order will only be validated once the requested documents have been provided to SAS ANSEPIAL or its bank service providers. In the event that such information is not provided within the time limits set by SAS ANSEPIAL and/or PAYPLUG following a request for communication, the order will be considered automatically cancelled, without SAS ANSEPIAL and/or PAYPLUG being held liable in this respect.
In any event, Mymonture.com reserves the right to refuse or cancel any order from a CLIENT with whom there is: a dispute relating to the payment of a previous order, a doubt as to his identity, a doubt as to his solvency, a doubt as to his capacity to contract.
5. Services
5.1 ONLINE THIRD-PARTY PAYMENT third-party payment services
sAS ANSEPIAL offers online third-party payment for your eyeglasses and contact lenses from over 300 approved supplementary health insurance providers.as part of the third-party payment process, SAS ANSEPIAL is required to pay in advance the costs incurred by the beneficiary's primary health insurance fund and supplementary health insurance providers. Once the optical equipment has been installed and the third-party payment procedures completed, the outstanding balance will be charged to the customer.
Process
the online third-party payment process on mymonture.com is simple. All you have to do is choose your glasses and/or contact lenses and :
1°) Configure your lenses by selecting "Yes, I would like to benefit from online third-party payment".
2°) Fill in and import the required information
Supplementary health insurance providers card and valid prescription (less than 5 years old for people aged between 16 and 42, or less than 3 years old for people aged over 42).
3°) Confirm your order by choosing the "Third-party payment" option (full or partial payment according to the contract with your supplementary health insurance providers), pending receipt of payment from your insurance company. No payment will be requested at this stage.
4°) SAS ANSEPIAL takes care of everything; we take care of requesting a quotation from your supplementary health insurance providers. The resulting documents will be available for electronic signature in the third-party payment section of your customer account.
5°) Return your signed documents to us, together with the remaining amount, so that we can prepare and dispatch your equipment.
Out-of-pocket expenses
once the third-party payment procedure has been completed, you will be asked to pay the outstanding balance, so that we can prepare and dispatch the optical equipment.
If there is no outstanding balance, the equipment will be finalized as soon as the beneficiary has signed the documents.
In order to finalize the advance payment, you may be asked (depending on the conditions of your supplementary health insurance providers) to sign the documents relating to the reimbursement from your customer account by electronic signature.
The supplementary health insurance providers will pay SAS ANSEPIAL directly. The main advantage of third-party payment is that you don't have to pay anything in advance!
In the event of an error in supplementary health insurance providers' reimbursements, SAS ANSEPIAL reserves the right to claim payment from the beneficiary.
Terms and conditions
to be eligible for THIRD-PARTY PAYMENT on mymonture.com, the following conditions must be met.
SAS ANSEPIAL must have an agreement with your supplementary health insurance provider. If third-party payment is not possible, mymonture.com will provide the beneficiary of the corrective equipment with the documents required to obtain reimbursements from the various healthcare organizations. (Healthcare reimbursement form and invoice) The customer will be asked to pay the full cost of the order in advance in order to finalize and ship the corrective equipment.
Corrective eyewear must not have been purchased within the last 2 years.
Only corrective eyeglasses or contact lenses are concerned.
The beneficiary of the corrective equipment must be affiliated to a primary health insurance fund (up to date rights).
The beneficiary of the corrective equipment must have a valid supplementary health insurance providers contract offering third-party payment.
There must be no current claim for reimbursement. If a claim is in progress, the beneficiary of the corrective equipment will be asked to cancel it before the equipment is delivered by mymonture.com.
SAS ANSEPIAL will not accept reimbursements beyond your supplementary health insurance providers.
In accordance with the law and the fight against supplementary health insurance providers fraud, SAS ANSEPIAL will not modify or transform invoices.
Deadlines
Third-party payment response times may vary from 1 to 20 days, depending on our conditions for preparing and dispatching your equipment.
Your equipment or contact lenses will only be prepared and dispatched on receipt of all documents, duly completed and signed, and payment of any remaining charges.
5.2 '100% Santé' scheme (full cover)
As part of the '100% Santé' scheme (full cover), the Mymonture.com website offers its customers frames that comply with CE standards, with a price equal to or less than 30 euros (incl. VAT), as well as lenses at regulated prices, which vary according to correction and lens type.
The '100% Santé' scheme is fully covered by French national health insurance and supplementary health insurance providers. The CLIENT enters his or her corrections directly on the Mymonture.com website, and the price is automatically calculated on the basis of these corrections and parameters.
The customer is responsible for entering his or her corrections when a quote is issued. A qualified optician checks every eyeglasses order placed online, and we contact customers if there is any doubt about the correction entered.
5.3 Estimates
All '100% Santé' scheme (full cover) orders, equipment (frame + corrective lenses), online third-party payment requests and prices are quoted free of charge prior to completion of the sale. A standardized quotation is available on request and is valid for 30 days from the date of issue.
The quotation is considered accepted by clicking on the "order" button. Alternatively, THE CUSTOMER may print out, complete and sign the quotation and return it by e-mail or post with the words "bon pour accord" ("good for agreement"), or sign the documents using an electronic signature sent by our partner yousign.
5.4 Your 2nd pair for just €1 more
This 2nd Pair from 1€ More offer is to be chosen at the same time as the purchase of the main equipment (frame + lenses) + a High Definition or Blue Clear treatment, from a selection of "OCTIKA" optical or sunglasses frames offered on the www.mymonture.com and will be fitted with either 2 Uni-focal 1.5 white or sun lenses (correction -6/+4, cylinder+2/-2), or 2 organic progressive 1.5 white or sun lenses, (correction -6/+4, cylinder +2/-2, add 1 to 3).

5.5 Contact lens renewal

Wearing a particular brand of contact lenses must be approved by an ophthalmologist, who will carry out all the necessary tests to ensure that the lens is compatible with your ocular parameters.
Before changing lens brands, always refer to an authorized professional for testing and validation.
If you experience any discomfort, redness, irritation, tearing or visual disturbance, remove your lenses and consult an authorized healthcare professional as soon as possible.
By ordering your contact lenses on the mymonture.com website with the "renew lenses" button, the CLIENT certifies that he/she has already carried out the necessary adaptation tests and also acknowledges that he/she has no contraindications to wearing these contact lenses.
5.6 30-day money-back guarantee
You've ordered a frame but it doesn't meet your expectations? The size, shape or color doesn't suit you? Not 100% satisfied with your purchase? Don't panic!
Based on the principle that everyone has the right to make a mistake or change their mind, your Mymonture online optician offers a "Satisfied or your money back within 30 days" service. We'll take back or exchange your sunglasses or optical frames in the shortest possible time.
To take full advantage of this service, please read the following terms and conditions. There are several possibilities:
You have ordered one or more frames.
You can return your order within 30 days of receipt of your parcel (the colissimo tracking date of your parcel being proof of delivery) instead of the 14 days stipulated in article L121-20 of the French Consumer Code. Please note that you are responsible for this shipment.
When you request an exchange or refund, you are held responsible for any damage caused during the return of the parcel. For this reason, we strongly advise you to send your parcel by registered mail or recorded delivery to the following address:

All returned items must be new, unused, undamaged, undirty and undamaged, otherwise they will not be accepted for return. All items in the parcel must be returned in their original packaging, including the original spectacle case and lens wipes. SAS ANSEPIAL will reimburse you within 8 days of receipt of your returned package.
You have ordered an optical frame for your eyesight:
In the case of corrective lenses, SAS ANSEPIAL reserves the right to partially reimburse your order (in accordance with articles L. 121-20-2 and L. 121-20 of the French Consumer Code). Please note that only the frame will be reimbursed. As the lenses have undergone transformations, they cannot be reused by third parties. In the case of a third-party payment order, the frame will be reimbursed on the basis of the amount remaining to be paid, as supplementary health insurance providers do not reimburse on the basis of the fixed price.
A processing fee of €10 will be deducted from your payment.
5.7 Lens replacement
SAS ANSEPIAL offers its CUSTOMER the possibility of mounting lenses on a frame that does not come from the Mymonture.com website or that has already been worn. Once your order has been placed, you will receive a prepaid label to send us your frame in order to mount your new lenses (only valid in mainland France) and a liability release form in the event of damage to and/or breakage of the frame and/or technical impossibility of changing optical lenses.
For its part, SAS ANSEPIAL undertakes to take all necessary precautions during this period. In the event of breakage of the frame or any part, SAS ANSEPIAL undertakes, by agreement, to carry out a free repair if this is possible (welding or part replacement). If repair is not possible, SAS ANSEPIAL may offer a free replacement frame with a maximum value of €30 from the OCTIKA collections, in which the lenses can be adapted.
5.8 Home trial (valid only in mainland France)
SAS ANSEPIAL offers you the opportunity to try on 1 to 3 optical frames at home. These frames will be delivered to you without corrective lenses. Valid only in mainland France and does not include corrective sunglasses and sports glasses.
Terms and conditions
An at-home trial can include a maximum of 1 to 3 frames per shipment. The number of frames you choose (from one to a maximum of three). If you choose to order a frame with corrective lenses from us.the frame(s) shipped must be returned to Mymonture.com within thirty days (i.e. 30 clear days) of placing your order.

Once you have chosen your frame(s) and paid by mail, Mymonture.com prepares the order for shipment. If you decide to keep a frame or mount your lenses, contact our opticians on 03 21 91 40 40 from Monday to Friday 10am-6pm to order your complete equipment (frames + lenses, online third-party payment, 2nd pair offer...) and we'll send you a prepaid label. Return shipment is free of charge for the customer. To return your frame(s), simply put them in their original case and slip them into the parcel. Then stick the prepaid return label on the package and drop it off at your nearest post office.
If the frame is not returned
If you have not returned the frame(s) within 30 days of placing your order, or if the frame(s) have been damaged, soiled or damaged.in the event of partial return of the frames, SAS ANSEPIAL will reimburse you for the frames returned, provided that they are in good condition.
5.9 Quality control :
Following an order, each pair of corrective glasses (lenses and frames) and contact lenses is checked by a qualified optician before delivery to the customer.
6. Delivery - Receipt of products
6.1 Methods of delivery :
Customers must choose a delivery method before validating their order. Delivery is made by chronopost to a relay point or ups Domicile.
Delivery times and rates vary according to the delivery method chosen by the Customer.
The different delivery methods and conditions in terms of delivery times and rates are detailed on the "Delivery methods" page of the Site. The proposed delivery times refer to delivery times once the order has been handed over to the carrier, i.e. once it has been processed and prepared by SAS ANSEPIAL's teams. Delivery costs will not be refunded if the product is returned and a refund is requested.
6.2 Terms of delivery:
products are delivered to the address indicated by the Customer when validating the order and according to the delivery method chosen.
The order will be accompanied, where applicable, by the delivery note, the invoice and the corresponding healthcare reimbursement form and any other necessary documents.
The delivery time indicated to the Customer at the time of validation of the order is given as an indication only and is counted from the time of full payment by the Customer. SAS ANSEPIAL cannot be held responsible for the consequences of a delay in delivery for which it is not responsible.
In the event that Products in the same order are not available at the same time, the order will be delivered as a whole on the latest delivery date or. The Customer may, however, request partial delivery depending on the different availability of Products.
In addition to the information sent by e-mail, the Customer may follow the progress of his/her order and delivery by logging into his/her account and consulting the " My Account " section.
In the event that the Customer does not receive his/her order within the timeframe indicated, he/she is invited to contact SAS ANSEPIAL and the chosen carrier to ensure that the order is dispatched correctly.
6.3 Eyeglasses and contact lenses delivery times :
Upon receipt of payment and the necessary data (prescription, pupillary distance measurements, contact details) to fit the Eyeglasses, the Company will do its utmost to deliver the order for a pair of eyeglasses with corrective lenses within 15 days for shipment to metropolitan France, and within 30 days for shipment to Europe. in all cases, the Company undertakes to deliver within a maximum of 30 working days from the date of the complete order for the product or service, subject to availability of stock and subject to availability of the product from our suppliers. On receipt of the necessary data, the Company will provide the customer with an estimated delivery date, subject to available stocks.
However, these delivery times only apply strictly to orders placed through the online purchase and payment process. Any order not respecting this process (mail order...) is eligible not to be processed by our services and or to generate an additional delivery delay.
The delivery times indicated on the Site do not take into account postal processing times or processing times related to transport and delivery.
Shipping times indicated on the Site are given as an indication and are non-contractual. They are calculated on the basis of average restocking times and are subject to constant change.
6.4 Receipt of Products :
Delivery of the order is deemed to have taken place when the order is made available to the Customer.
The Customer is obliged to accept the order sent to him.
If the order is not received, it will remain at the Customer's disposal for a certain period of time at the sorting center or warehouse of the carrier chosen by the Customer. The Customer must collect the order in accordance with the carrier's terms and conditions.
In the event that the Customer does not collect the order within the required time and conditions, the unclaimed order will be returned to SAS ANSEPIAL who will inform the Customer by e-mail. In the event that the order is returned to SAS ANSEPIAL for a reason attributable to the Customer (package not claimed on time, incorrect delivery address, etc.), the cost of return delivery will be deducted:
- 9.90€ will be deducted from the refund for France,
- 20€ will be deducted from the refund for European countries
- 45€ will be deducted from the refund for countries outside France and Europe.
In the event of reshipment of the parcel, the Customer will have to pay new delivery charges for the reshipment of his order
6.5 Checking the order and Products:
SAS ANSEPIAL takes great care in packing and assembling the parcels, but they may be damaged in transit.
In accordance with article L.216-2 of the French Consumer Code, any risk of loss or damage to the Products is transferred from the seller to the consumer when the latter takes physical possession of the goods.
the Customer is therefore required to check the condition of the packaging and the conformity of the Product at the time of delivery, and must immediately notify the carrier of any reservations he may have concerning the condition of the Product delivered, so that they can be noted on the carrier's delivery slip.
sAS ANSEPIAL therefore recommends that , before accepting the parcel, the Customer :
-to carefully examine the condition of the parcel;
-check that the delivery note corresponds to the Product delivered;
-check that the Product delivered corresponds to the order placed.
If, at the time of this verification, the Customer observes an apparent defect (e.g.: the box is damaged, split open or open, etc.), transport damage (e.g.: a package is missing), non-conformity (e.g.: the Product is different from that ordered, an item is missing, etc.), he/she must :
-purely and simply refuse receipt of the Product; and
-indicate his/her precise, complete and signed observations on the delivery note;

if no complaint is made within the aforementioned time limit and conditions, the Products delivered will be deemed to have been accepted by the Customer.
The Customer acknowledges that in the absence of correct information within the aforementioned time limits, the order will be deemed to be compliant and the Products delivered to be free of any apparent defects, and the Customer's complaint will be deemed to be inadmissible and not enforceable against SAS ANSEPIAL.
Any Product returned without the agreement of SAS ANSEPIAL will be refused by SAS ANSEPIAL and returned to the Customer at the latter's expense and risk.
To be validly returned to SAS ANSEPIAL and/or exchanged, Products must not have been used and must be returned intact in their original packaging with any accessories, user manuals and other documentation.
In the event of disputed delivery or non-delivery of Products (impersonation, non-delivery or indication of non-delivery by the Customer), the Customer will be informed of the reason for non-delivery.ception by the Customer), a complaint must be lodged with the Police or Gendarmerie and a copy sent to the Customer, so that the latter can assert its rights.if no complaint is lodged, the product cannot be re-delivered. In the event of re-delivery of the product following the disputed delivery, the order will be re-sent with acknowledgement of receipt, and no reimbursement for this shipment will be possible.
In the event that the customer declares non-receipt of the parcel or that the contents of the parcel are incomplete, even though the carrier confirms that the delivery is in order, the customer must provide us with a complaint in order to enforce his rights with the carrier. Without this complaint form, no claim will be accepted for re-delivery of the product. In the event of re-delivery of the product following the delivery dispute, the order will be delivered in AR, and no refund on this shipment will be possible.
In the event that the Products returned do not conform to the Customer's order or present an apparent defect, SAS ANSEPIAL undertakes, at the Customer's option :
- to reship to the Customer a new compliant product, paying for the reshipment and return costs, or
- replace the said Product with another Product of the same category and price, with SAS ANSEPIAL paying the return and reshipment costs; or
- cancel the order and reimburse the Customer for all costs incurred, only if the return concerns all products in the same order.
Any refund will be made in accordance with the conditions set out in the "Refund" article.
6.6 Customs fees and returns :
The customer must pay all customs duties and import taxes, in accordance with the requirements of the competent authorities of his country, for the products ordered. For orders shipped outside the European Union, these charges, set by the customs authorities of the country of delivery, are the sole responsibility of the recipient and must be paid in order to allow delivery of the parcel.
In the event of an unjustified refusal to accept delivery, for example, if customs duties have not been paid, or in the event of repeated absences during delivery attempts, or if the consignee is unable to collect the parcel, we will not be held responsible.or if the parcel is returned due to non-payment of taxes required by local authorities, it will be returned to Mymonture. In this situation, shipping and return costs, including any customs duties applied on the return, will be deducted from the amount of the refund made by our customer service department after receipt and verification of the parcel, 20€ for European returns and 45€ for International returns.
However, in the event that the return is the result of an error attributable to Mymonture.com (for example, non-conforming product, damaged item, etc.), all return costs, including customs duties, will be paid by Mymonture.com.
7. Warranties
SAS ANSEPIAL guarantees that the Products sold comply with French and European Union regulations. The Customer benefits from all legal guarantees applicable to the Products in question, and in particular the guarantee of conformity or the guarantee against hidden defects. This warranty is for 2 years on both lenses and frames. It is limited to one replacement for the frame or corrective lenses.
SAS ANSEPIAL declines all responsibility in the event that the item delivered does not comply with the legislation of a country other than a member of the European Union. It is the CUSTOMER's responsibility to check with the local authorities regarding the possibility of importing or using the products ordered.
Broken equipment must be sent to Mymonture.com at the customer's expense.
7.1 Adaptation warranties
Progressive lenses : For a period of 5 months from receipt of your glasses, SAS ANSEPIAL undertakes to replace your corrective lenses in the event of visual maladjustment for our Novacel and ESSILOR lenses. This guarantee covers one-time replacement of lenses by :
* applicable only in the event of written proof from the ophthalmologist who issued the original prescription (ophthalmic error). This adaptation warranty does not affect the consumer's rights under the legal warranty set out in articles 1649 bis to 1649 orties of the French Civil Code.
* another pair of lenses with the same correction in VL or VP
* by replacing a range of superior lenses (the difference in price will be charged to the CLIENT)
Replacement lenses must be in the same price range. Any difference in price will be charged to the customer, and no reimbursement will be possible. This guarantee does not apply to second pair packages. This guarantee does not apply to scratches on lenses. Assembly costs are charged at €10 for a rimmed frame, €20 for a half-rimmed frame and €30 for a pierced frame.
Lenses: only annual lenses (Lunelle, Menicon, Quatum and Z6) come with a two-month adaptation guarantee.
7.2 Commercial and after-sales guarantees
The quality of the products available on the Site is guaranteed by their respective manufacturers. Valid under normal conditions of use and on presentation of damaged parts.
The Lens Warranty covers glass breakage with a 40% deductible. Limited to one replacement, even with corrections.
7.3 Warranty exclusions
This warranty covers manufacturing or material defects. Products that have been damaged or misused are not covered by the SAS ANSEPIAL warranty program.
In addition, any modifications to Mymonture frames (e.g. fitting other brands of lenses) or to our original suppliers' frames will invalidate the warranty.
Lenses are not guaranteed against scratches caused by misuse or carelessness. all warranties exclude deterioration due to wear and tear, foreign causes, improper use and maintenance, etc.
7.4 General after-sales service conditions
within the framework of the warranty, SAS ANSEPIAL will repair, exchange or replace one or more spare parts, or even the entire defective product, depending on the Supplier's assessment.
The parts that may be invoiced are complete frames, bare frames, pairs of lenses and accessories (cords, cases, etc.). In this case, we ask you to return the defective part for non-billing (accompanied by the order form). The return must be made within 15 days of receipt of the part.
Shipping costs are 6.90 euros for deliveries within metropolitan France.
Shipping costs are 20 euros for European countries.
Shipping costs for the rest of the world are 45 euros.
Broken equipment must be sent to SAS ANSEPIAL at the customer's expense.
For a better analysis of the fault, or if you wish to send us your frame for repair, you can return it by postal tracking to the following address: SAV MYMONTURE - 13 RUE MONTJOIE - 62280 SAINT MARTIN BOULOGNE.
Please enclose a letter stating your contact details and the nature of the fault.
As soon as we receive your frame, we will be able to offer you, as a priority, the repair or exchange of your item, while stocks last.
We recommend that you use a shipping method with parcel tracking. SAS ANSEPIAL cannot be held responsible for lost or damaged packages.

in the event of a request for expert appraisal, the cost of return shipment will be borne by the customer.
7.5 Legal warranties of conformity
French Consumer Code:
Article L211-4
The seller is obliged to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery.
He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when the latter has been made his responsibility by the contract or has been carried out under his responsibility.

The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
The Customer may make any claim to MYMONTURE.com by contacting MYMONTURE.com using the contact details on the " Contact Us " page of the Site.
The Customer is solely responsible for the use he makes of the Products. Thus, MYMONTURE.com cannot be held responsible in case of mishandling, lack of caution or non-compliance by the Customer with the instructions for use.
Article R. 4362-15
The optician delivers, at the patient's request and free of charge, relevant, targeted, appropriate and individualized advice during the hours and days indicated on the website.
The optician, if he considers it justified, recommends a medical consultation, particularly in the event of discomfort expressed by the patient, following the use of the product delivered.
8. Product returns and right of withdrawal
8.1 Product returns
SAS ANSEPIAL will systematically check Products returned by the Customer, whatever the reason.
All products in our catalog are at the customer's expense.
Given the nature of the products, returns will not be accepted if the products or their packaging have been used, opened, modified or altered in any way. Any request for the return of goods authorized by SAS ANSEPÏAL can only be effective if the delivery of the goods is less than one month, and therefore the products must be returned in perfect condition, in their original packaging, complete (instructions, cases, accessories, warranty and authenticity card, etc.), undamaged, undamaged and undamaged..), undamaged, unused, unsoiled, without marks and with healthcare reimbursement form and invoice corresponding to the order. 8.2 Right of withdrawal :
the Customer has a period of thirty (30) clear days from receipt of the Products to exercise his right of withdrawal from SAS ANSEPIAL instead of the legal period granted. When this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.
Given the nature of the Products, the return of Products will not be accepted if the Products or their packaging have been used, opened, modified or altered in any way. Consequently, Products must be returned in perfect condition, in their original packaging and wrapping, complete (instructions, cases, accessories, warranty and authenticity card, etc.), undamaged, unused, unsoiled, without marks and with the healthcare reimbursement form and invoice corresponding to the order. SAS ANSEPIAL reserves the right to refuse a return if the above conditions are not met.
Returned Products are intended to be marketed in new condition.
By way of exception and in compliance with the conditions of article L.121-21-8 of the French Consumer Code, the Customer has no right of withdrawal for Products that have been calibrated or adapted to the Customer's specific requirements and/or whose health or safety protections have been violated. For example, the Customer has no right of withdrawal if frames have been adapted to the Customer's morphology, or if contact lens cases or care solutions have been detected.
The withdrawal procedures to be followed by the Customer are detailed on the "Right of withdrawal" page of the Site. The Customer must consult these withdrawal procedures and follow the process indicated therein.
The Customer may obtain, at his/her discretion, an exchange, a credit note or a refund for the Products returned. This choice will be made by the Customer to SAS ANSEPIAL before or at the latest upon return of the Products. In the case of a refund, the return costs will be borne by the Customer. If the Customer does not make a choice, he/she is informed that he/she will obtain a credit note that can be used on the entire Site for a future order.
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for certain Products, in particular :
- Sealed goods which cannot be returned for health or hygiene reasons and which have been unsealed by the consumer (art. L221-28, 5°).

In the event of the return of a frame equipped with corrective lenses (adapted to the eyesight), only the frame will be reimbursed. The lenses are not reusable as they have undergone a transformation.

9. Refunds and exchanges :
In all cases, SAS ANSEPIAL will only reimburse the Customer for the price paid by the Customer for the Product(s) returned. The Customer will be credited with the corresponding amount on the means of payment given at the time of the order, excluding delivery costs.
The Customer may also obtain a credit note for an amount equivalent to the amount that should have been refunded. Any credit note may be reimbursed.
The Customer will be reimbursed within a maximum of eight (8) days at the latest from the date on which the Customer exercises his/her right to reimbursement.
In the case of the return of a frame equipped with lenses adapted to the customer's vision, only the frame will be reimbursed. The lenses are not reusable as they have undergone a transformation. If you order THIRD-PARTY PAYMENT equipment, the frame will be reimbursed up to the amount remaining to be paid for the frame. No reimbursement can be made to supplementary health insurance providers after validation of coverage (supplementary health insurance providers' general conditions of sale).
No refunds or exchanges will be made in the event of carrier disputes.
During sales periods, the customer has a cooling-off period of 14 days from the date of receipt of the item. The customer may then exchange the item or be reimbursed, without penalty and without having to justify his or her decision. The cost of returning the product remains at the customer's expense.
In the event of refusal or unclaimed parcels on delivery, the cost of reshipment or cancellation of the order is €6.90, which will be deducted from your payment.

In the case of a frame fitted with prescription lenses (adapted to the customer), only the frame will be reimbursed. (Made to measure. Articles L. 121-20-2 et L 121-20-4 du code de la consommation)
9.3 Returning eyeglasses, contact lenses and sunglasses :
When returning packages to our workshops, eyeglasses must be accompanied by the original healthcare form ("cerfa" sheet) and the invoice (no refund or exchange will be granted without the return of the original).

The lenses concerned are as follows: Perfexion HR RX Toric Progressive lenses, HR PerfeXion RX Toric lenses, ophthalmic Universel Hydrogel lenses (progressive, spheric, Toric, Toric Progressive), universal silicone Hydrogel progressive lenses (spheric, Toric, toric Progressive), Quantum 1 and 2 lenses, ultra Multifocal lenses for astigmatism, biofinity Toric Multifocal lenses, Z6 and Z6 contact lenses.
Return and refund conditions: Returns not claimed within 14 days of receipt of the product will be refunded in full for the amount of the glasses, contact lenses. However, delivery charges will be deducted as follows:
For colissimo delivery: 6.90€ will be deducted from the refund.
If your parcel is refused or not claimed on delivery, the cost of re-sending the order will be €6.90 by colissimo in mainland France or the cost of postage in the country of delivery.
Purchases covered by a third-party payment cannot be cancelled, reimbursed or exchanged (in accordance with our commitments with our supplementary health insurance providers). This is also an exception to the right of withdrawal.
9.4 RAY-BAN META connected glasses (Gen 2, Headliner, Skyler and Wayfarer models)
RAY-BAN META connected glasses, including Gen 2, Headliner, Skyler and Wayfarer models, fall within the scope of the above exceptions, provided that :
- Their original packaging has been opened or unsealed,
- They have been used, modified, soiled, damaged or altered in any way whatsoever.
In such cases, no returns, refunds or exchanges will be accepted.
Only Products that are unopened, sealed, complete, intact and in their original packaging may be returned for refund or exchange.
The Customer expressly acknowledges and accepts this limitation at the time of ordering.
